利用規約

この利用規約（以下「本規約」といいます。）は、[AjumpWorld]（以下「本サービス」といいます。）が提供するサービスの利用条件を定めるものです。ユーザーは、本サービスを利用することで、本規約に同意したものとみなされます。

第1条（適用）

本規約は、ユーザーと本サービス運営者との間のサービスの利用に関わる一切の関係に適用されます。

第2条（禁止事項）

ユーザーは、本サービスの利用にあたり、以下の行為をしてはなりません。

• 法令または公序良俗に違反する行為
• 本サービスのサーバーやネットワークに支障を与える行為
• 虚偽または第三者の情報を用いて店舗を登録する行為
• 他ユーザーまたは第三者の権利・利益を侵害する行為
• その他、運営が不適切と判断する行為

第3条（ユーザーによる投稿情報）

• ユーザーは、店舗情報、レビュー、画像その他本サービスに投稿する全ての情報について、真実かつ正確であり、第三者の権利を侵害しないことを保証するものとします。
• 虚偽の情報、誤解を招く情報、または第三者の権利を侵害する情報を投稿したことにより発生したいかなる損害や紛争についても、その責任は投稿したユーザーに帰属し、本サービス運営者は一切の責任を負いません。
• ユーザーは、投稿する画像について、被写体となる人物その他第三者の肖像権、プライバシー権、著作権等の権利を侵害していないことを保証するものとします。 投稿された画像に起因して第三者との間で紛争が生じた場合、その責任は当該画像を投稿したユーザーが負うものとし、本サービス運営者は一切の責任を負いません。
• 本サービスに掲載される店舗情報の一部は、ユーザーにより作成または編集されたものであり、当該店舗の公式情報であることを保証するものではありません。 掲載される情報の正確性、完全性、最新性について、本サービス運営者は一切保証しません。
• また、運営者は、投稿された情報が不適切または本規約に違反すると判断した場合、事前の通知なく、当該投稿内容の全部または一部を削除・編集・非表示にできるものとします。
• 投稿内容に関する通報、削除、修正等の要請について、本サービス運営者は可能な範囲で対応しますが、即時の対応や特定の結果を保証するものではありません。
• ユーザーが投稿したレビューまたはその他のコンテンツにより第三者（店舗等）に損害が生じ、その内容が明らかに虚偽の情報または悪意ある誹謗中傷に該当すると運営が判断した場合、当該ユーザーはその損害を賠償する責任を負うものとします。 ただし、ユーザーが実際に体験した事実に基づく合理的な意見や感想であると認められる場合には、この限りではありません。
• 実在する店舗の関係者は、本サービス上の店舗情報について、正当な権限を有することを示した上で、公式情報としての管理を申請することができます。 本サービス運営者は、申請内容の確認のため、申請者または当該店舗に連絡を行う場合がありますが、申請が必ず承認されることを保証するものではありません。

第4条（著作権および知的財産権）

• 本サービスに掲載されているすべてのコンテンツ（文章、画像、動画、デザイン等）の著作権およびその他の知的財産権は、本サービス運営者または正当な権利を有する第三者に帰属します。
• ユーザーが本サービスに投稿したコンテンツ（店舗情報、レビュー、画像等）の著作権は当該ユーザーに帰属しますが、ユーザーは本サービスの運営に必要な範囲で、当該コンテンツを無償かつ非独占的に利用（複製、公開、翻訳、改変を含む）する権利を本サービスに許諾するものとします。
• ユーザーは、投稿したコンテンツについて、第三者の権利を侵害していないことを保証するものとし、これに関連して紛争が生じた場合は、自己の責任と費用においてこれを解決するものとします。

第5条（自動情報収集の禁止）

• 本サービスにおけるコンテンツ（店舗情報、レビュー、画像等）について、スクレイピング、その他自動的な手段による情報収集を禁止します。ただし、検索エンジン等、正当な権限を有するクローラーによるアクセスを除きます。
• ユーザーまたは第三者が本条に違反して本サービスの情報を無断取得し、複製・転用・公開・販売等を行った場合、当該者は本サービス運営者に対して、その行為により生じた一切の損害（逸失利益を含む）を賠償する責任を負うものとします。
• また、当該行為が悪質であると判断される場合、本サービス運営者は法的措置を講じることができるものとします。

第6条（外部サービスの利用）

• 本サービスでは、店舗の位置情報（緯度・経度）を取得するために Google Geocoding API を使用しています。
• この機能を通じて取得されるデータには、Googleの利用規約およびプライバシーポリシーが適用されます。
• ユーザーはこれに同意した上で本サービスを利用するものとします。

第7条（サービスの変更・中断・終了）

• 運営は、ユーザーに事前に通知することなく、本サービスの内容を変更、中断または終了できるものとします。
• これによって生じた損害について、運営は責任を負いません。

第8条（免責事項）

• 本サービス上に表示される情報の正確性・有用性・最新性について、一切保証しません。
• 投稿された情報に基づいて発生したトラブルや損害について、運営は責任を負いません。
• 本サービスの利用に関連してユーザーに生じた損害について、運営は一切の責任を負いません。

第9条（利用規約の変更）

• 運営は、本規約の内容を変更することがあります。変更後の規約は、本サービスに掲載された時点から効力を有します。
• 変更後も引き続きサービスを利用する場合、ユーザーは変更後の規約に同意したものとみなされます。

第10条（準拠法および管轄）

• 本規約は、日本法に準拠します。
• 本サービスに関連して生じた紛争については、運営所在地を管轄する地方裁判所を専属的合意管轄裁判所とします。

This English version is for reference purposes only. The Japanese version shall prevail in case of any inconsistency.

These Terms of Use (hereinafter referred to as “these Terms”) set forth the conditions for using the services provided by [AjumpWorld] (hereinafter referred to as “the Service”). By using the Service, users are deemed to have agreed to these Terms.

Article 1 (Application)

These terms of service ("Terms") apply to all relationships between the user and the operator of the service (“AjumpWorld”).

Article 2 (Prohibited Acts)

Users shall not engage in any of the following acts:

• Acts that violate laws or public order and morals.
• Acts that interfere with the Service's server or network.
• Registering stores using false or third-party information.
• Infringing the rights or interests of other users or third parties.
• Any other acts deemed inappropriate by the operator.

Article 3 (User-Posted Information)

• Users guarantee that all information they post on this service, including store information, reviews, images, and any other content, is truthful and accurate, and does not infringe upon the rights of any third party.
• Any damages or disputes arising from the posting of false information, misleading information, or information that infringes upon the rights of third parties shall be the sole responsibility of the user who posted such content, and the service operator shall not be held liable in any way.
• Users guarantee that any images they upload do not infringe upon the portrait rights, privacy rights, copyrights, or any other rights of any third party, including individuals appearing in such images. In the event of any dispute with a third party arising from uploaded images, the responsibility shall lie solely with the user who uploaded the images, and the service operator shall bear no responsibility.
• Some store information displayed on this service is created or edited by users and is not guaranteed to be official information provided by the respective stores. The service operator makes no guarantees regarding the accuracy, completeness, or timeliness of such information.
• The service operator reserves the right to remove, edit, or hide all or part of any posted content without prior notice if it is deemed inappropriate or in violation of these Terms.
• While the service operator will make reasonable efforts to respond to reports, deletion requests, or modification requests regarding posted content, immediate action or specific outcomes are not guaranteed.
• If user-posted reviews or other content cause damage to third parties (including stores), and such content is determined by the service operator to be clearly false or constitute malicious defamation, the user who posted such content shall be responsible for compensating such damages. This shall not apply, however, to reasonable opinions or impressions based on the user’s actual experiences.
• Authorized representatives of actual stores may apply to manage store information on this service as official information by demonstrating legitimate authority. The service operator may contact the applicant or the relevant store for verification purposes; however, approval of such applications is not guaranteed.

Article 4 (Copyright and Intellectual Property)

• All content displayed on this service (including text, images, videos, designs, etc.) is the property of the operator or a third party with legitimate rights.
• Copyright of content submitted by users (such as store information, reviews, and images) belongs to the respective user. However, by submitting content to the service, users grant the operator a free, non-exclusive license to use such content for operation purposes (including reproduction, publication, translation, and modification).
• Users represent and warrant that their submitted content does not infringe on any third-party rights. In the event of any disputes, users shall resolve them at their own responsibility and expense.

Article 5 (Prohibition of Automated Data Collection)

• The collection of content from this service (including but not limited to store information, reviews, and images) through scraping or other automated means is strictly prohibited. However, this does not apply to access by search engine crawlers or similar systems that are legitimately authorized.
• In the event that a user or third party violates this Article by unauthorized acquisition, reproduction, redistribution, publication, or sale of information from this service, the responsible party shall be liable to compensate the service operator for any damages incurred, including lost profits.
• Furthermore, if such actions are deemed malicious, the service operator reserves the right to take legal action against the offending party.

Article 6 (Use of External Services)

• The Service uses Google Geocoding API to obtain location information (latitude and longitude) of stores.
• The data obtained through this function is subject to Google’s Terms of Service and Privacy Policy.
• Users agree to these conditions when using the Service.

Article 7 (Changes, Suspension, and Termination of the Service)

• The operator may change, suspend, or terminate the content of the Service without prior notice.
• The operator shall not be liable for any damages resulting from such changes.

Article 8 (Disclaimer)

• The Service does not guarantee the accuracy, usefulness, or timeliness of the information displayed.
• The operator assumes no responsibility for any trouble or damage resulting from user-posted information.
• The operator shall not be liable for any damages incurred by users in connection with the use of the Service.

Article 9 (Changes to the Terms of Service)

• The operator may change the content of these Terms. Changes will take effect upon being posted on the Service.
• Continued use of the Service after changes implies acceptance of the revised Terms.

Article 10 (Governing Law and Jurisdiction)

• These Terms shall be governed by the laws of Japan.
• Any disputes related to the Service shall be subject to the exclusive jurisdiction of the local court at the operator’s location.
